By booking a tour with Food Tours of America, you signify your agreement to these terms and conditions. If you do not agree with any part of these terms, you should not book a tour.
Purchases and Bookings
All purchases and bookings through the Site, over the phone, or via email are final and subject to these Terms and Conditions. By making a booking, you are deemed to have accepted these Terms on behalf of yourself and any guests you book for.
Payments
Food Tours of America accepts Mastercard, Visa, American Express, and Discover as methods of payment. Full payment is required to confirm your booking. All payments will be processed through Food Tours of America, incorporated in Texas.
Pricing
All tours are priced and charged in U.S. Dollars (USD). The rates are based on the current market and may vary slightly from rates found online. Food Tours of America updates its rates regularly to reflect any fluctuations in currency exchange or market conditions.
Promotional Codes Any promotional codes provided must be used at the time of purchase and cannot be applied retroactively. Promotional codes are not stackable and must be used according to the specific conditions of each code.
Cancellation and Amendments
Cancellations or amendments to your booking can result in fees as outlined in our Cancellation Policy available on our website. Notifications of cancellations or amendments must be sent via email and are considered valid only upon confirmation from Food Tours of America.
Refunds
No refunds are available for unused portions of a tour. Refunds for cancellations are subject to our Cancellation Policy. Refunds, where applicable, will be processed at the discretion of management.
Weather Policy
Weather is, by nature, variable; however, inclement weather is not considered a force majeure event. In the event of inclement weather, Food Tours of America will modify the tour route/logistics or reschedule the event, prioritizing the safety of guests and employees. Decisions regarding weather-related cancellations or rescheduling are at the sole discretion of Food Tours of America.
Force Majeure
Neither party will be liable for failure to perform obligations due to events beyond their control, such as acts of God, terrorism, pandemics, and other severe disruptions. Affected parties must inform others of such events and endeavor to fulfill terms and conditions as much as possible.
Liability
Food Tours of America acts only as an agent for third-party providers of services such as transportation and does not own or operate such entities. Therefore, Food Tours of America is not liable for any acts, omissions, or mishaps that may occur during services provided by third parties.
Travel Insurance
Food Tours of America strongly recommends that all guests purchase comprehensive travel insurance to cover unforeseen circumstances that may lead to cancellations or disruptions of the tour.
Dispute Resolution
Any disputes arising under these Terms will be governed by the laws of the State of Texas, USA. Disputes will first be submitted to mediation, and if unresolved, to binding arbitration in Texas.
Intellectual Property
All content on the Site is owned by Food Tours of America or its licensors. You may not use, copy, or reproduce any part of the Site or its content without express written permission.
